　——吴让见不构成贪污、贿赂罪的再审辩护词

　审判长、审判员：

　本律师曾是吴让见贪污、受贿案一审、二审的辩护人，今天作为该案再审的辩护人，再次出庭履行辩护职责，真是感慨万千！为这一天，我们整整等了七年。曾经不可一世，极尽对吴让见打击报复之能事的程海波，因受贿数额巨大被判处死刑。因举报程海波买官卖官、受贿的反腐勇士吴让见，终于等到了拨开乌云见青天的时刻。下面，我将依照事实和法律，发表如下辩护意见。

　中心辩护意见：指控吴让见犯贪污罪、受贿罪不能成立，应依法宣告吴让见无罪。

　一、检察机关在侦查期间收集的刘显生、侯雪梅等证人证言以及吴让见的供述和辩解均系非法证据，依法应予排除。

　1、检察机关在侦查期间对证人刘显生所做的两次调查笔录属非法证据。

　违法之一：非法羁押证人取证。

　证人刘显生是美籍华人。2003年6月，刘显生被常德市检察院拘传，限制人身自由达11天。2003年6月4日，被限制人身自由的刘显生，违心向检察机关做了给吴让见送5万元的证言。迄今，卷宗内没有对刘显生被拘传及被限制人身自由的任何法律手续，该行为显然违法。

　违法之二：对证人采取威胁、欺骗，引诱等方法取证。

　刘显生多次作证称，办案人员在向他取证时说：1、刘有向武陵区比黄理清官更大的官员行贿，将目标指向吴让见；2、办案人员已经掌握了刘行贿的确实证据，说了能早点出去；3、吴的家属已经承认了；4、省检察院很重视，最好在常德讲清楚，否则问题就严重。显然，办案人员在向刘显生取证时，有威胁、引诱、欺骗和指供等违法行为。刘显生在办案人员的循循善诱下，按照办案人员的意图，将其2000年春节给吴让见拜年的情节中，加入了送5万元的情节，形成了2003年6月4日的证人证言。显然，该证言是采取非法的方法取得的。

　违法之三：连环设套，企图固定非法言辞证据。

　其一：根据违法取得的刘显生的言辞证据，突破吴让见的口供防线，违法取得吴让见有罪供述的言辞证据。刘显生6月4日的证言，被正欲打击报复吴让见无门的人如获至宝。6月9日，吴让见被宣布“两规”，检察机关代替纪委人员介入，将突破重点放在刘显生送5万元上面。吴让见当庭供述称，他一直想不起来这回事，没有承认。办案人员先是引诱，称吴承认了就不予追究，并列举了区长韦绍斌等人没有追究的例子，吴未予承认。接着就是威胁，称吴不承认，事情就复杂化。果然，吴让见妻子侯雪梅被限制人身自由，家里被搜查，直到7月8日纪委解除“两规”，检察机关传唤。吴让见觉得，他的问题不断升级，就是没有按照检察机关的意图交代。这样，吴让见在检察机关的威胁、欺骗和诱导下，违心做了有罪供述。次日，吴让见被刑事拘留。

　其二、根据违法取得的吴让见的有罪供述，固定刘显生的虚假证言。2003年7月11日，检察机关再次向刘显生调查时，刘显生否认送钱的事实。检察机关拿出吴让见承认送钱的供述，刘显生只好再次违心做虚假证言。检察机关并威胁刘，翻案要负法律责任。

　2、检察机关在侦查期间对证人侯雪梅所做的调查笔录为非法言辞证据。

　违法之一：超越管辖，错误立案。

　常德市检察院于2003年7月4日对侯雪梅作出常检反贪（2003）13号《立案决定书》，罪名为窝赃。根据《刑事诉讼法》第十八条规定，窝赃案由公安机关管辖，作为办理反贪、渎职案件的检察机关，对窝赃案件没有管辖权，且吴让见当时并未被立案侦查，赃款客观上不存在，则以窝赃立案，缺乏起码的事实依据。

　违法之二：越主代庖执行强制措施，以监视居住之名，行羁押取证之实。

　《刑事诉讼法》第五十一条第二款规定：“取保候审、监视居住由公安机关执行”。据二审卷材料：2003年7月4日，常德市检察院办案人员魏峥嵘、刘朝明宣告对侯雪梅监视居住。2008年8月25日，常德市检察院办案人员卜兴炎等对侯雪梅宣告取保候审。上述两份常德市公安局的法律文书上，居然签着常德市检察院办案人员的大名。如此作为，要么是越主代庖，要么是检察人员冒充公安人员，无论哪一种情况，都是严重违法的。

　监视居住顾名思义，是办案机关限令犯罪嫌疑人、被告人在规定期限内不得离开住所或者指定住所，并对其加以监视的强制措施。侯雪梅本有住所，检察机关将侯雪梅带至五强溪招待所107室，名为监视，被限制人身自由长达57天，与羁押无异。

　违法之三：连续讯问证人长达30小时严重违法，是典型的变相刑讯逼供。

　据卷宗材料：检察机关侦查人员郭建、龚德村于2003年8月20日10点30分至21日16分时30分，对侯雪梅做了连续长达30小时的讯问，取得了侯雪梅承认收刘显生5万元钱的事实。据侯雪梅自书证言和二审出庭证言，检察机关对其还采取了威胁、欺骗、引诱、指认等非法方法取证，明显违反了《刑事诉讼法》第四十三条、第九十二条、第九三条之规定。

　3、检察机关在侦查期间，对吴让见收集的言辞证据为非法证据。

　违法之一：纪委机关立案，检察机关办案违法。

　2003年6月9日常纪字（28）号《实施两规通知书》及市纪委《调查笔录》，2003年7月8日市纪委《调查笔录》显示，吴让见在“两规”期间，市纪委工作人员没有对吴让见做任何涉及案件情况的调查，两份笔录仅有宣布“两规”和解除“两规”的记载。常德市检察院反贪污贿赂局《关于吴让见受贿一案的案发及破案的详细过程》记载：“纪委和检察机关联合对其问题进行调查，以检察机关为主，纪委配合”。由此证明：纪委立案，检察机关办案，是典型的违反《宪法》、《刑事诉讼法》原则的。

　违法之二：检察机关办案人员冒充公安机关人员执行拘留、逮捕违法。

　卷宗第三卷中，有关吴让见的拘留证、逮捕证上盖有常德市公安局的大印和局长傅绍祥的名章，却分别写着检察机关办案人员魏峥嵘、傅绍宏，龚德村、徐光辉的名字，并标明为常德市公安局的侦查人员。检察机关办案人员执行逮捕，与刑事诉讼法规定相悖。明明吴让见当时已被限制人身自由，不在政府二院宿舍，居留证、逮捕证填写的吴让见出所仍为市政府二院宿舍。办案人员的这一做法，不仅违法，且系严重造假。

　违法之三：采取欺骗、引诱、威胁等手段调取被告人供述。

　吴让见一审、二审、再审的当庭供述，证实侦查人员采取了欺骗、引诱、威胁等手段，对其录取口供。刘显生、侯雪梅等证人均有同样事实的指控，且能相互印证，检察机关违法取证的事实，应该予以认定。

　综上所述，检察机关在侦查期间对刘显生、侯雪梅、吴让见等人取得的言辞证据严重违法，根据《刑事诉讼法》、最高人民法院《关于办理刑事案件排除非法证据若干问题的规定》等有关规定，应当依法予以排除，不能作为定案的依据。

　二、吴让见没有收受刘显生5万元贿赂，且未为刘显生谋利，原裁判认定吴让见受贿错误。

　1、刘显生多次证言证实：没有给吴让见送过5万元钱。

　证人刘显生2004年6月21日的自书证言、2004年6月24日在汉寿县法院所作的《调查笔录》、2004年11月22日郑维民律师对刘显生作的《调查笔录》、刘显生在二审的当庭证言、常德市检察院2011年10月9日对刘显生所作的《调查笔录》均证实：没有给吴让见送过5万元钱。

　2、证人侯雪梅的多次证言证实：不知道刘显生送过5万元钱。

　证人侯雪梅在一审递交给法院的《关于我当时为什么违心承认刘显生送给我家5万元钱的情况说明》、侯雪梅2004年6月9日向汉寿县法院所作的《调查笔录》及二审出庭的证言均证实：其不知道刘显生送5万元钱的事实。

　3、吴让见一审第二次开庭的供述和辩解、二审的当庭供述和辩解证实：其没有收到刘显生所送5万元。

　4、检察机关在侦查期间取得的刘显生的证言、侯雪梅的证言以及吴让见的供述，系非法言辞证据，不能作为认定事实的依据。

　5、诸多证人证言及书证证实：吴让见没有同意以火车站大市场土地为刘显生开办的汉光科技公司抵押贷款。

　刘显生、黄理清、廖颂扬、姜胜国、冷付军的证言，以及武陵区政府1999年7月25日《工作记录》、汉光科技2000年5月15日《关于请求提供资产抵押的报告》、该公司2000年11月1日《关于提供贷款抵押物的报告》、该公司2000年11月8日《关于借用火车站大市场公司土地使用权的承诺》等众多证据证实：7.25会议不涉及以火车站大市场为汉光科技公司提供抵押的事实，刘显生贷款寻求贷款抵押物支持是找区政府，没有和吴让见联系，有关提供抵押物的报告上，有区长、副区长签字同意，没有吴让见的签字。据此证明，吴让见没有为汉光科技公司谋利。

　三、吴让见收受刘勇8000元现金已经交区纪委，原裁判认定吴让见受贿错误。

　1、吴让见不知道刘勇所送8000元为郑敏芳所送。

　吴让见在一审、二审、再审当庭供述，其收了刘勇所送1万元，但不知是郑敏芳所送，认为是刘勇的私人馈赠。郑敏芳的证言称，郑敏芳将8000元交给刘勇，刘勇将钱交给吴让见时，他不在场。由此可以认定：吴让见不知道刘勇所送8000元为郑敏芳所送。

　2、吴让见已将刘勇所送8000元交给纪委。

　原武陵区纪委副书记、监察局长徐文彬的自书证言以及2011年7月15日其向检察机关所做的《调查笔录》、2002年3月6日武陵区纪委收到吴让见廉洁自律款的收据等证据证实：因刘勇于2001年撑头发生芦山乡玉带桥闹事事件，吴让见认为刘勇不可信，遂主动于2002年春节后上交自律款时，特地讲明了该款包含刘勇所送的钱。吴让见在原一审、二审均有相关供述，能够相互佐证。原裁判以吴让见上交廉洁自律款包含刘勇所送8000元依据不足而不予认定，显系将控方应承担的举证责任，强加于被告人头上，是错误的。由此证实，吴让见没有受贿的主观故意。

　3、吴让见没有直接利用职务便利为刘勇、郑敏芳谋利。

　卷宗内，没有任何有关吴让见给刘勇谋利的证据。原判认定吴让见安排郑敏芳之子到武陵区外经局当临时工司机，是利用职务上有隶属关系的其他国家工作人员的职权为郑敏芳谋利是错误。因为：

　其一、吴让见鉴于时任市人大主任的彭孟芝批条和郑敏芳是武陵区老同志的身份，请姚建平给武陵区外经局长邓朝晖打招呼，安排郑敏芳之子工作，主观上并无为郑敏芳谋利的故意，客观上也没有利用自己的职务便利。姚建平是武陵区人大主任，在法律上与吴让见没有职务上的隶属关系；

　其二、姚建平给邓朝晖打招呼，也是基于和邓朝晖私人关系好，而非因职务上的隶属关系。

　综上所述，吴让见不明知其所收刘勇的8000元现金是郑敏芳所送，主观上没有为郑敏芳谋利的故意，客观上也没有直接利用其职务便利为郑敏芳谋利。更重要的是吴让见已经将刘勇所送8000元上交纪委，足见其没有受贿的主观故意。

　四、吴让见不构成贪污罪，原裁判将认定吴让见贪污属定性错误。

　武陵区机关事务办第24号记账凭证、马玉芳出具的5万元借条、支票存根、马玉芳1998年3月4日开户于邮政储蓄活期存、武陵区机关事务办《暂付款》等书证证实：1998年2月25日，马玉芳向区机关事务办借款5万元，借条上标明的借款内容为“区领导出国用”。同年3月4日，马玉芳将该款存入个人活期存折。4月17日，马玉芳取款3万元，兑换3000元美金，交吴让见。5月12日，马玉芳取款1万元，交赵国平，后赵国平将该款交给吴让见。1998年7月30日，马玉芳用发票报账，偿还了该借款5万元。

　上列事实，形成了如下法律关系：其一、马玉芳与机关事务办之间的借款关系；其二、马玉芳将该借款转入个人账户，根据“账户资产属实名人所有”及货币为种类物的特征，该公款已改变性质为马玉芳的私款，且无任何证据证明马玉芳公款私存得到领导同意或第三人认可；其三、马玉芳将私款中的35800元交给吴让见，吴让见一直未还，形成了吴让见和马玉芳之间的债务关系；其四、马玉芳利用票据到机关事务办报账，偿还其经办所借的5万元，形成虚报票据的法律关系。

　基于上述基本事实和法律关系，本辩护人认为：

　1、吴让见回国后没有向马玉芳还款或者报账，形成了吴让见与马玉芳之间债的法律关系，依法不受刑法调整。

　如前所述，如果以马玉芳个人账户资金来源论，马玉芳个人账户资金为公款，则吴让见领款后未还款或者未交账，形成了拖欠公款的法律关系；如果马玉芳个人账户资金以法律规定论，应认定为私款，则吴让见与马玉芳之间形成了私人债务关系。无论是哪一种关系，吴让见没有还款或者没有交账，均只应认定为“债”，债的法律关系系民法调整范围，不属刑事案件的范畴。

　2、马玉芳公款私存、擅自使用部分资金以及自寻发票报账冲抵5万元借款等行为，违反了财经纪律。马玉芳虚报借款的行为，并非吴让见指使。马玉芳实施上述行为，既没有和第三人商量，也没有征得领导同意，应认定为马玉芳个人违反了财经纪律，由此证实，马玉芳是本案利害关系人。

　3、马玉芳所称小金库账目中，并无吴让见出国借支的任何凭证。则原裁判就“吴让见指使下属将其占有公款的账目进行处理，致使其使用公款的事实得以掩盖”等认定，明显不符合客观事实。

　4、原裁判认定吴让见指使马玉芳销毁“小金库”账目的依据明显不足。理由为：其一、证人赵国平、李飙、谢刚的证言及吴让见的供述，均不能证明吴让见指使马玉芳销毁账目的事实；其二、所谓指使销毁账目的事实，仅有马玉芳一个人的证言，系孤证，且马玉芳系利害关系人，不能作为定案的依据；其三、“小金库”账目中并无吴让见出国借支凭证，客观上也无账可供销毁，吴让见也无需通过销毁账目来达到占有目的。

　5、吴让见的供述及证人朱荣华的证言等证实，吴让见出国前到北京拜访领导老乡花费，回国时给同事送礼品，大部分已经因公开支。

　6、吴让见没有直接主管、经管财物的职务便利，现有证据不能证明吴让见实施了任何窃取、骗取、侵占公共财物的行为，故吴让见不具有贪污罪客观方面的构成要件。吴让见要完成贪污行为，必须通过马玉芳的行为完成，马玉芳没有受到刑事追究，足以证明吴让见的行为不属于贪污。

　7、著名刑法学家王作富认为（《刑法分则实务研究（下）》1707页）：“贪污罪是故意犯罪，必须以非法占有本单位财产为目的，因为只能是直接故意，不可能间接故意”。退一万步来说，即便吴让见明知是公款而占有，且拒不交账，这种放任的状态也只能的间接故意，也不符合贪污罪主观构成要件。

　审判长、审判员：七年前，我引用南宋词人辛弃疾的词“青山遮不住，毕竟东流去”，为吴让见的无罪而大声疾呼，但是因为权力对司法的干预，我们未能得到正义的回声。经过今天的庭审，应该说，本案是程海波为打击报复举报吴让见，在权力干预下炮制的彻头彻尾的冤案。我希望，我们人民的法官能够用正义和良知，作出一份经得起历史检验的公正判决。于吴让见来说，正义虽然迟来，但迟来的正义也是正义。
